It is Not Illegal To Record a Cop on a

Traffic Stop. But Should You?

Associate attorney Elmira Yousufi answers a question a lot of people have been asking in this video: Is it legal to record the police during a traffic stop? Hardly a day goes by without a traffic stop recording going viral for several reasons. But is it legal in California to record law enforcement during a traffic stop? Elmira answers the question with a resounding “Yes.”

 

Although the answer is clear, there are some things to be mindful of if you intend to record the event. First, Elmira advises that you should not act aggressively toward the officer. She suggests that you be polite and respectful, and perhaps even state that you will be recording the stop. At the same time, do not do anything that could be interpretated as trying to hinder the investigation.

 

Unfortunately, many officers are not aware that it is legal to record the traffic stop. But it is…as long as doing so doesn’t delay the lawful execution of law enforcement’s duties.

David P. Shapiro Weighs In on Possible Menendez Brothers Re-Sentencing & Their Parole Eligibility

The week of October 24 was a busy one at the Firm with multiple media appearances regarding the potential release from custody of Lyle & Erik Menendez, brothers who have been in custody since the 1989 double murder of their parents in Beverly Hills.  


David P. Shapiro was quoted in Yahoo news with his thoughts prior to the official announcement on October 24 by Los Angeles District Attorney George Gascon that his office would recommend the brothers’ sentences be modified from “special circumstances murder” to first degree murder absent “special circumstances.” If approved by a judge, the sentences would convert from life without the possibility of parole to 50 years-to-life. This is significant, since both Lyle and Erik have served well beyond the minimum 25 years that would be needed to be parole eligible since they committed the crimes prior to their 26th birthday.  


Hours after the District Attorney’s press conference on Thursday, October 24, David was welcomed in studio at ABC 10News San Diego, where he explained what the announcement really means, what the next steps are, and how long it could be before the Menendez brothers are released, if at all.
