The juvenile justice system in San Diego is not simply a duplication of the adult criminal justice system aimed at dealing with minors, that is, those under the age of 18. While there are various similarities between the two, our Firm has put together at least 10 videos available on our
YouTube channel, including videos by Managing Partner David P. Shapiro and Associate Attorney Elmira Yousufi, dealing with various aspects of juvenile proceedings. The thrust of the videos is that the differences between adult court and juvenile court are so significant that it is essential, if you or your child is facing a petition in juvenile court, that you work with a criminal defense law firm that has quality experience and success in handling juvenile cases. Just as in adult court, you or your child’s freedom and future are at stake when facing criminal charges.
Here are just some of the differences:
- The terminology is different.
- The goal is different.
- The court location is different.
- There is no cash bail in juvenile court.
- While the case is being presented, the courtroom is not open to the public.
- The potential consequences are different.
- There is no right to a jury trial.
At the same time, the videos point out that there are similarities between the two systems, including the right to remain silent, the right to counsel, and various other constitutional guarantees. Know your rights!
Finally, these videos provide important advice about how to act (and dress) in juvenile court, the role of parents, circumstances under which a juvenile adjudication can be a “strike” offense, what happens when you turn 18 before the juvenile proceeding takes place, and matters that make a huge difference in how a particular case should be handled.
