As part of our Firm’s continuing efforts to always deliver excellence and create a positive and lasting impact to the San Diego community beyond criminal defense, we were thrilled to be a sponsor for the second straight year at NFL Hall of Famer Andre Reed’s Celebrity Golf Tournament this past May. Proceeds from the event went to the Andre Reed Foundation, which helps underprivileged children to read by funding reading rooms at Boys & Girls Clubs throughout the country. When presented with the opportunity to lend a hand and fund a new reading room at a Boys and Girls Club, David and the firm jumped at the opportunity and agreed to the $10,000 donation. We look forward to sharing photos from the enshrinement and ribbon cutting ceremony!

What is Proof Beyond a Reasonable Doubt?
One of the most basic, yet foundational, aspects of criminal law is the concept of proof beyond a reasonable doubt. Partner Stefano L. Molea addressed proof beyond a reasonable doubt and other burdens of proof in this video. While we hear the expression “proof beyond a reasonable doubt” often, what does it really mean? The explanation that is often used at trials is that it is "an abiding conviction” that the charges are true. Stefano explains that to focus a jury’s attention on how high that burden is, he will often put it in context by explaining to the jury various levels of proof required in our legal system. They include:

  • Reasonable Suspicion. The proof necessary for law enforcement to detain an individual.
  • Probable Cause. The level of proof required to arrest a person on a criminal charge.
  • Preponderance of the Evidence. Used in civil cases, often where money is at issue, this means essentially “more likely than not,” or 51%.
  • Clear and Convincing Evidence. The proof necessary, for example, to take a child away from his or her parents.
  • Proof beyond a reasonable doubt. The highest level of proof required, and the burden is on the prosecution to meet this standard as to every element of the crime to obtain a conviction.
