Whether or not you’ve ever been arrested or charged with a crime, undoubtedly you have questions about how the criminal justice system works. Who decides whether to press criminal charges? Short answer: The prosecutor. Many people are under the misconception that the decision to charge someone with a crime is made by the alleged victim or the complaining witness. But it is the prosecutor who looks at the evidence and determines whether they believe they will be able to prove that the would-be defendant is guilty of a crime beyond a reasonable doubt.
 
Can the police lie to me? Short answer: Absolutely! Stefano goes on to describe different situations where this issue can arise, including undercover cops lying about being cops, and lying by the police in the context of an interrogation during which they tell you they have evidence against you which, in fact, does not exist.
 
When do the police have to read me my Miranda rights? Short answer: They don’t have to read you your rights unless and until you have been arrested or are in custody, and they’re asking you questions designed to elicit an incriminating response.
