Top 3 Misconceptions About the Coronavirus and San Diego Criminal Defense
The past two months have been an adjustment for us all. Speaking the truth and providing accurate information is an obligation that extends far beyond politics. We feel it is imperative to set the record straight regarding the top 3 misconceptions about the coronavirus and how best to handle your criminal case in San Diego.
- “There’s not a lot that can be done until the courts reopen. Why hire an attorney now when my first court date is so far out? There’s plenty of time.” Failing to plan is planning to fail! There is plenty that can be done between now and your next court date. If you have not yet hired a quality, locally experienced, reputable criminal defense law firm to represent you, use this “down time” to do so. Research several firms. Note their similarities and differences. Follow them on social media. Know what, and who, you are hiring to help you protect your interests. If you have a reputable law firm working with and for you already, why not use this time to be even further prepared and ahead of the prosecution when courts reopen? If ever there is a time to be in a position to negotiate a favorable outcome for your case, it will be in the coming weeks.
- “The Criminal Business Office is Closed. Thus, my expungement petition is on ice.” Not true. As of late April, dismissal petitions under Penal Code section 1203.4 (commonly referred to as “expungements”) can be emailed to the Court. The longer you wait, the further behind your petitions will be. Just in the past few weeks, we have received several granted petitions from those we filed before the Court closures, and have filed some new petitions as well.
- “I won’t be able to contact my attorney because everyone is out of the office.” Not at our Firm! Although our team of five (3 attorneys and 2 assistants) are working almost exclusively from home, we are still meeting with clients (virtually) and our commitment to excellence is as strong as ever. Be wary of any criminal defense law firm that has not risen to the challenge during these times!
